Mactan Isla Resorts, union sign first CBA

Mactan Isla Resorts and the Mactan Isla Resorts Employees Union ALU-TUCP  recently  sign their maiden  CBA as RCMB Director Edmund T. Mirasol looked on.  The signing was held at the  NCMB –RB 7 DOLE Building, General Maxilom Avenue corner Gorordo Avenue, Cebu City on April 12, 2013.

National Conciliation and Mediation Board  Executive Director Reynaldo R. Ubaldo reported today that the union and management representatives of Mactan Isla Resorts have signed their first ever CBA.

Citing a report from RCMB 7 Director Edmund T. Mirasol Ubaldo said the parties signed their CBA on  April 12, 2013  during a simple ceremony held at the  RCMB 7 office. Read more  

Checker receives monetary claims through SENA

A checker was paid P 20,000 in separation and other benefits after the Regional Conciliation and Mediation Branch IV-A resolved his complaints against his employer through the Single Entry Approach (SENA).

Mr. Hilario G.  Ocoma, who worked for eleven years at Sun Moon Star Hardware and Construction Supply in Barangay Lalo, Tayabas, Quezon, filed a complaint for illegal dismissal,  non-payment of overtime and holiday pay against his employer last April  8, 2013.

National Conciliation and Mediation Board Executive Director Reynaldo R. Ubaldo, in his report to Labor and Employment Secretary Rosalinda D. Baldoz, said the complaint of  Ocoma was settled on April 15, 2013,  during the first and only  conciliation meeting presided by RCMB IV-A  Officer-in-Charge  Director Gil  G. Company, union  submit wage woes to voluntary arbitration

A labor dispute against Leyte III Electric Cooperative (LEYECO III) on the alleged non-implementation of wage orders and salary guidelines filed last April 8, 2013 at the National Conciliation and Mediation Board Regional Branch VIII has been submitted for voluntary arbitration, NCMB Executive Director Reynaldo R. Ubaldo announced today.

“The union filed a preventive mediation case against the management, citing non-implementation of NEA salary guidelines and wage orders no. 16 and 17 among their list of concerns,” he said.

A report from RCMB VIII Conciliator-Mediator Tomas B. Biboso also stated that the union is questioning management’s decision on implementing a salary increase based on NEA guidelines. The union told Biboso that some employees received salary increases while the others did not. Read more

NCMB chief resolves dispute vs Banana handlers

With the team effort of two conciliator-mediators and the supervision of National Conciliation and Mediation Board Executive Director Reynaldo R. Ubaldo, the settlement of the labor case filed against banana handler, Craft Haven International Services, Incorporated (CHISI) has been resolved in five conciliation meetings conducted in just over a month.

 “In the interest of industrial peace, our team composed of RCMB XII Officer-In-Charge Feliciano R. Orihuela Jr., RCMB XI Officer-in-Charge Paciano L. Murro Jr. and I facilitated the settlement of the preventive mediation case filed against CHISI,” Ubaldo said.

“I had to personally attend to this matter because aside from the ongoing CBA negotiations, 12 employees were affected by a redundancy program implemented by the management,” he added. Read more

SENA saves 350 jobs at Unilever Philippines

For 350 contractual workers of Unilever Philippines, Inc., the termination of the service contract between the UPI and their employer, the Excel Quality Incorporated came as a blessing in disguise.

Facing the prospect of going jobless when the service contract between their employer and its principal ended in December 2012, their worries turned into joy after the NCR branch of the NCMB succeeded in negotiating for the absorption of a majority of the workers by the UPI.

“The NCMB NCR, through the efforts of Conciliator-Mediator Angelita Narvaez, managed to persuade the management of Unilever Philippines to absorb 350 of the 630 workers,” NCMB Executive Director Reynaldo R. Ubaldo said. Read more

7 seafarers get P18 M in awards through conciliation

NCMB Executive Director Reynaldo R. Ubaldo reported today the settlement through conciliation of various claims filed by seafarers in the NCR branch of the National Conciliation and Mediation Board.

In his report to Labor Secretary Rosalinda Dimapilis-Baldoz, Ubaldo said seven seafarers benefited from the more than P 18 M in monetary awards resulting from the settlement of their cases during the months of February and March 2013.

“Each of the seven seafarers got benefits ranging from P1.4 M to P3.6 M,” Ubaldo said. Read more

 

RCMB 3 settles ULP dispute at fiberglass factory

The preventive mediation case involving Bahrain Fiberglass has been settled amicably, effectively preventing the escalation of the case into a more serious labor dispute, NCMB Executive Director Reynaldo R. Ubaldo said today.

The case, which was filed by the Bahrain Fiberglass Workers Union on March 11, 2013 was settled on March 27, 2013 through the efforts of RCMB 3 Conciliator-Mediator Onofre H. Bautista,” Ubaldo said.

The union had accused management of unfair labor practice, citing violation of certain provisions of the CBA, non-remittance of SSS and Pag-ibig contributions, harassment, inhuman working conditions, and non-compliance of the agreement facilitated by NCMB. Read more  

 

Pawnshop cashier’s claims resolved in just one day

Jefferson Bonilla has been working with Cebuana Lhuillier as cashier for less than a year when he decided to quit, yielding to the lure of greener pasture abroad.

In November 2012, he left the company and flew to Dubai in search for a better opportunity.

But having left in haste, he failed to collect his 13th month pay and differential on his wage adjustment, as well as the certification of his premium contributions with SSS, Philhealth, and Pag-ibig. Read more  

 

NCMB settles case involving exclusive school

The notice of strike involving the Paref Southridge School for Boys has been amicably settled following successful conciliation efforts of NCMB-NCR, NCMB Executive Director Reynaldo R. Ubaldo said today.

Citing a report from NCR OIC Amorsolo V. Aglibut, Ubaldo said the parties agreed to settle on March 18, 2013, putting an end to their protracted CBA negotiations.

On December 11, 2012, the union, Paref Southridge Teachers Union, filed a notice of strike alleging bargaining deadlock on the issues of scholarship for dependents, union leaves, de-loading of union president and vice-president, union coverage, sabbatical leaves, sick leave conversion, retirement benefits, service awards, credit leaves, signing bonus, and wage increase. CONCILIATION SOLVES CBA DEADLOCK IN GLASS COMPANY

Anglo-Watson Glass, Incorporated and its union have agreed to terminate their labor dispute and forge an agreement after reaching an amicable settlement in just four conciliation meetings, National Conciliation and Mediation Board Executive Director Reynaldo R. Ubaldo announced yesterday.

“The settlement time of this labor dispute was commendable, considering that the case filed was a Preventive Mediation case,” Ubaldo said.

The union filed a PM case on February 25, 2013, against Anglo-Watson Glass, Inc., alleging negotiation stalemate on economic issues in their Collective Bargaining Agreement. Read more

NCMB-NCR CUTS SETTLEMENT TIME OF LABOR WOES VS THRIFT BANK

The bargaining deadlock involving the Luzon Development Bank has been amicably resolved in just a matter of two conciliation meetings with the help of the National Conciliation and Mediation Board–NCR, NCMB Executive Director Reynaldo R. Ubaldo announced yesterday.   

“The union and the management of the bank originally allotted four conciliation meetings for negotiations but both parties managed to reach a settlement on their second meeting,” Ubaldo said.

The Association of Luzon Development Bank Employees-PTGWO filed a notice of strike against Luzon Development Bank on March 6, 2013, alleging negotiation stalemate on all economic issues. Read more

 

RESOLUTION OF ULP ISSUES PAVES WAY FOR CBA NEGOTIATION

National Concilation and Mediation Board Executive Director Reynaldo R. Ubaldo announced today the amicable settlement of the Notice of Strike filed by the Batangas Star Express Corp. Workers Union-AGLO against Batangas Star Express, Corporated, diffusing tensions that could have led to a debilitating strike in the bus company.

Citing a report from Conciliator-Mediator George R. Ridad of RCMB IVA, Ubaldo said the parties agreed to settle on April 3, 2013 following successful efforts by Con-Med Ridad to resolve their differences.  

According to Ridad, the union filed a notice of strike on March 22, 2013 for alleged unfair labor practice, specifically harassment, discrimination, and union busting. Read more 

 

LABOR CASE VS BANANA GROWER RESOLVED THROUGH CONCILIATION

The bargaining standoff involving Davao-based banana grower, Sumifru Philippines Corporation and its union, have been settled in just a matter of three conciliation meetings, National Conciliation and Mediation Board Executive Director Reynaldo R. Ubaldo announced yesterday.

“The efforts of RCMB XI in amicably settling the case in just three conciliation meetings is commendable considering that the union raised thirteen issues in their bargaining standoff,” Ubaldo said.

Citing a report from Officer-in-Charge Paciano L. Murro of RCMB-XI, Ubaldo said the union filed a preventive mediation case on February 28, 2013 for negotiation gridlock on thirteen economic provisions of the CBA. Read more    

 

PNOY SIGNS MANDATORY CONCILIATION-MEDIATION LAW

Malacanang Palace has reaffirmed the role of the National Conciliation and Mediation Board in the preservation of industrial peace and workplace harmony through the signing into law of Republic Act No. 10396 or the Mandatory Conciliation-Mediation Law, Labor Undersecretary Rebecca C. Chato announced last March 19, 2013 at the launching of the 2013 Best Practices Awards on Workplace Harmony and Productivity in Quezon City.

“President Aquino gave conciliation-mediation a boost with the signing into law of R.A. 10396 last March 14, 2013, institutionalizing conciliation-mediation as a voluntary mode of dispute settlement for all labor cases,” Usec. Chato said.  

“The article on conciliation-mediation shall be inserted as article 228 of Presidential Decree No. 442, otherwise known as the Labor Code of the Philippines,” she said. Read more   

 

CONCILIATION-MEDIATION SETTLES BARGAINING DEADLOCK

The bargaining deadlock involving the Jason Manufacturing Phils. Corp. has been amicably settled after a series of conciliation-mediation conferences, National Conciliation and Mediation Board Executive Director Reynaldo R. Ubaldo announced yesterday.

“We are pleased to announce that both parties have mutually agreed to settle their labor dispute in the interest of industrial peace,” Ubaldo said.

The union filed a preventive mediation case on January 22, 2013, citing bargaining deadlock on economic issues on wage increase, signing bonus, rice subsidy, death benefits, hospitalization, and compulsory retirement. Read more   

 

PAVA HAILS OUTSTANDING VOLUNTARY ARBITRATORS AWARD

“It is high time that we recognize exemplary voluntary arbitrators to encourage them to excel and contribute to the labor justice system.”

Philippine Association of Voluntary Arbitration (PAVA) President Atty. Delia Uy thus said as she spoke at the launching of the 2013 Best Practices Awards on Workplace Harmony and Productivity.

The 2013 Search for Outstanding Voluntary Arbitrators Award is one of the three awards launched by the National Conciliation and Mediation Board to enhance the promotion of voluntary arbitration program and to motivate voluntary arbitrators to improve their performance in the handling and resolution of labor cases. STEEL MANUFACTURER, UNION SIGNS CBA AFTER BARGAINING DEADLOCK

Regan Industrial Sales Incorporated and its union finally agreed on the terms of their a Collective Bargaining Agreement following successful negotiations facilitated by RCMB-NCR, National Conciliation and Mediation Board Executive Director Reynaldo R. Ubaldo said yesterday. 

“On March 6, 2013, the Nagkakaisang Samahan ng mga Manggagawa sa Regan-NSMR-ADLO-KMU filed a notice of strike, citing deadlock in negotiations for the remaining two years of their CBA,” Ubaldo said.

The union specified wage increase, 13th month pay, Christmas bonus, monthly allowance, separation pay, back wages, signing bonus, sick leave/vacation leave, office rental and union leave as issues in the negotiation stalemate. Read more  

 

WORKPLACE DEMOCRACY VITAL TO THE ECONOMY

The importance of addressing workplace issues and concerns in empowering the economy in today’s challenging economic condition was emphasized by Labor Undersecretary for Labor Relations Rebecca C. Chato during the launching of the 2013 Best Practices Awards of Workplace Harmony and Productivity at the Ichikawa Hall, Occupational Safety and Health Center in North Avenue, Quezon City on March 19, 2013.

“Businesses could only be protected by highly evolved employer-worker relation,” Usec. Chato said in her keynote speech.

By highly evolved employer-worker relations she meant the existence of labor management committees or councils (LMCs) in the workplace. An LMC is a mechanism designed to encourage positive interaction between management and workers and promote industrial peace. It is a body composed of representatives from both labor and management that resolves issues of common interest. Read more

 

Philippines strike-free for first quarter of 2013

NCMB Executive Director Reynaldo R. Ubaldo has reported that the entire country was strike-free for the first three months of 2013.

In his report to Labor Secretary Rosalinda Dimapilis-Baldoz, Director Ubaldo said that it was the second year in a row that no strike occurred during the first quarter.

“We did this through the provision of timely, efficient, and effective conciliation-mediation services to parties involved in potential or brewing labor disputes,” he said.

“Our time tested strategies of 24/7 conciliation and team/buddy conciliation have been effective in diffusing tensions between labor and management, preventing what could have been debilitating strikes in many companies,” Ubaldo said further.

Team conciliation and 24/7 scheme in attending to conciliation-mediation cases are being implemented by the NCMB to effectively manage  labor disputes and minimize, if not prevent losses to the workers, to the company, and to the economy.

Under the 24/7 scheme, conciliator-mediators are on call 24 hours a day, seven days a week to ensure quick response to clients’ requests for assistance and to make sure that labor disputes are attended to, with the purpose of bringing about early and amicable settlement.

Team, or buddy, conciliation is a scheme or strategy anchored on the principle “Two heads are better than one”. It involves partnering of two to three conciliators whose combined efforts and expertise are expected to facilitate settlement of critical and difficult cases.

“Threats of a strike also declined considerably, as notices of strike filed by unions continue to follow a downward trend,” Director Ubaldo disclosed further.  

He said that NCMB regional branches received 36 notices of strike during the quarter, 14% fewer than the 42 cases docketed during the same period last year.

There is a slight increase in workers involved in new notices of strike, though, hinting that bigger companies are the targets of fresh strike threats. Some 5,334 workers are involved in the 36 NS cases received during the first quarter of 2013, 2% more than the 5,230 workers involved in the 42 cases docketed in similar period in 2012.

Independent unions account for close to half – 17 cases or 47% –  of  the 36 new notices filed during the quarter, which indicates that an actual strike may not happen very soon.

Federated unions, or unions allied with federations and trade union centers, are more likely to declare a strike than the more moderate independent ones.

In 2012, all the three strikes were declared by unions allied with NAFLU-KMU. Of the 33 notices of strike pending as of 31 March 2013, ten cases were filed by unions allied with either KMU or NAFLU.

“We continue to exert efforts to maintain the current state of labor relations in the country, so disruptions in the industrial front do not get in the way of the administration’s efforts to secure a better life for our people, most especially the private sector workers who comprise a large segment of our population,” Ubaldo said.

Secretary Baldoz commended NCMB for its efforts and said that “with this development, we hope to attain our objective of zero strike this year.”

In CARAGA: Three new CBAs signed in a single week

NCMB Executive Director Reynaldo R. Ubaldo announced today the signing in March 2013 of three new collective bargaining agreements (CBAs) in the CARAGA region.

“This signing of three CBAs in a single month is unprecedented,” he enthused. “Actually, all three CBAs were signed within a single week, the second week of March 2013,” he said.

“First to sign their new CBA are the union and management of Prudential Brokerage Services, Inc., which set the tone for the signing of two more CBAs in CARAGA,” Ubaldo further said.

He said the parties signed their new CBA in simple ceremonies at the plant level on 12 March 2013.

”It is the first ever CBA between the parties,” Ubaldo said. “It will retroact to June 1, 2011 and shall be binding between the parties until May 31, 2016.”

“The economic provisions, however, will be up to May 31, 2013, meaning anytime now, the parties might be negotiating again for the economic provisions for the fourth and fifth years,” he added. Read more
